This Privacy Policy explains how Koedal, Inc. (“we,” “us,” or “our”) collects, uses, discloses, and safeguards your information when you use our mobile application Send it! Outside (the “App”), which allows users to share and discover locations through photos and related metadata. By creating an account and using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not create an account or use the App.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy in the App and updating the effective date. Your continued use of the App after changes constitutes your acceptance of the revised policy.

1. Information We Collect

We collect the following categories of information:

a. Information You Provide Directly

• Account Information: When you create an account, we collect your name and email address.
• User-Generated Content: Photos you upload, along with any metadata you supply, such as trail name, park name, photo name, or other descriptions.
• Communications: Any messages or feedback you send to us through the App or support channels.

b. Information Automatically Collected from Photos

• EXIF Data: When you submit a photo, we automatically extract and store available EXIF metadata, including GPS coordinates (latitude and longitude), timestamp, device information, and camera settings. This allows the App to display the location accurately for discovery and sharing features.

c. Automatically Collected Information

• Usage and Device Data: IP address, device type, operating system version, unique device identifiers, app version, and usage statistics (e.g., features used, time spent, crash reports).
• Location Data: In addition to photo EXIF GPS data, we may collect coarse location data (e.g., city or region) from your device if you enable location services for the App (you can disable this in your device settings).

We do not collect sensitive personal information (such as health data, racial or ethnic origin, or precise geolocation beyond what is embedded in your photos) unless you voluntarily include it in photo metadata.

2. How We Use Your Information

We use the collected information for the following purposes:

• To create and manage your account.
• To enable the core features of the App: uploading, storing, displaying, and sharing your photos and locations so other users can discover neat places.
• To process and organize user-supplied metadata (e.g., associating photos with trails or parks).
• To personalize your experience, such as showing relevant nearby locations based on shared GPS data.
• To communicate with you about your account, updates, or promotional offers (you may opt out of marketing emails at any time).
• To improve, debug, and analyze the App’s performance (using aggregated or anonymized data where possible).
• To enforce our Terms of Service, prevent fraud, and comply with legal obligations.
• For any other purpose with your consent or as otherwise permitted by law (including the broad license you grant us under our Terms of Use).

3. How We Share Your Information

Publicly Shared Content

Photos, GPS coordinates, metadata (trail name, park name, photo name, etc.), and any descriptions you provide are visible to other users of the App for sharing and discovery purposes. This content is inherently public within the App community. Please do not upload any information you do not want to be seen by others.

Service Providers

We may share your information with trusted third-party service providers who assist us with:

• Cloud hosting and storage (e.g., photo and data storage).
• Analytics and app performance monitoring.
• Email delivery and customer support.

These providers are contractually obligated to use your data only for the services they provide to us and to maintain confidentiality.

Legal and Safety Disclosures

We may disclose your information if required by law, subpoena, court order, or government request, or when we believe disclosure is necessary to:

• Protect the rights, safety, or property of the App, our users, or the public.
• Investigate or prevent fraud or illegal activity.

Business Transfers

In the event of a merger, acquisition, bankruptcy, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information or location data to third parties for marketing purposes.

4. Data Storage and Security

Your data is stored on secure servers (primarily in the United States or other jurisdictions with adequate data protection standards). We use industry-standard technical and organizational measures to protect your information, including encryption for data in transit and at rest, access controls, and regular security reviews.

However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security, and you use the App at your own risk.

5. Data Retention

We retain your account information and uploaded content for as long as your account remains active or as needed to provide the App’s services and maintain the community’s shared location database.

Account Deletion: You may delete your account at any time through the App settings. Upon account deletion:

• We will not delete the photos and associated location data (including GPS coordinates and metadata) you have uploaded.
• We will anonymize the content by removing your name, username, profile information, and any direct links to your account. The photos and location data will continue to be available in the App for other users to discover and enjoy as part of the public location-sharing feature.
• Your account details (name and email) will be deleted or irreversibly anonymized.

You may delete individual photos at any time, in which case we will remove them from active systems (though backup copies may remain for a limited period).

Automatically collected usage data is retained for analytics purposes for up to 24 months, after which it is deleted or anonymized.

6. Your Rights and Choices

• Access, Correction, and Deletion: You may request access to, correction of, or deletion of your personal information by contacting us at the email below. Note that anonymized photos and location data from deleted accounts cannot be individually attributed or deleted upon request.
• Opt-Outs: You can opt out of marketing communications via the unsubscribe link in emails or App settings. You may also disable location services or photo EXIF sharing through your device settings (note that disabling EXIF may limit some App features).
• Data Portability: Where required by law, you may request a copy of your data in a portable format.
• California Residents (CCPA/CPRA): You have additional rights to know, delete, and opt out of the sale of personal information. We do not sell personal information.
• European Union / GDPR Residents: You have rights to access, rectify, erase, restrict processing, object, and data portability. You may also withdraw consent where applicable. (Note: the right to erasure does not extend to anonymized content that has been integrated into the App’s public database.)

7. Children’s Privacy

The App is not intended for children under 13 (or 16 in certain jurisdictions). We do not knowingly collect personal information from children under 13. If we become aware that we have collected such data, we will delete it promptly. Parents or guardians may contact us if they believe their child has provided information.

8. International Transfers

If you are located outside the United States, your information may be transferred to and processed in the United States or other countries. We ensure appropriate safeguards (such as standard contractual clauses) are in place for such transfers.
